Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") are a legal agreement between you and rebel iQ, Inc. ("rebel iQ," "we," "us," or "our") governing your use of the rebel iQ AI platform, including all related tools, features, APIs, and content (collectively, the "Service").

By creating an account or using the Service, you confirm that you are at least 18 years old, have authority to bind yourself or your organization to these Terms, and agree to be bound by them. If you do not agree, do not use the Service.

2. Description of Service

rebel iQ AI is a self-serve marketing platform designed for mortgage, real estate, and insurance professionals. The Service includes AI-powered page building, lead capture forms, mortgage calculators, CRM tools, SWOT analysis, and related features. We may update, expand, or modify the Service at any time with or without notice.

3. Accounts and Registration

You must provide accurate and complete information when creating your account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at support@rebeliq.com if you believe your account has been compromised.

We reserve the right to suspend or terminate accounts that violate these Terms, contain false information, or remain inactive for extended periods.

4. Subscription Plans and Billing

The Service is offered on a subscription basis. Plan details, pricing, and included features are described on our Pricing page. Current plans include:

• Free — permanent free tier with limited features
• Starter — $29/month, includes a 14-day free trial
• Pro — $59/month (coming soon)
• Elite — $99/month (coming soon)
• Custom Domain add-on — $10/month per domain, available on any tier
• Sub-account seats — $15/seat/month on Starter and above

All payments are processed by Stripe. By providing payment information, you authorize us to charge you on a recurring basis according to your selected plan. Subscriptions auto-renew unless cancelled before the billing date. Prices are in USD and do not include applicable taxes.

Trials. New accounts receive a 14-day Starter trial with no credit card required. At the end of the trial period, your account will enter a 7-day grace period before downgrading to the Free plan if no subscription is purchased.

Refunds. Subscription fees are generally non-refundable. If you believe you were charged in error, contact us within 14 days at billing@rebeliq.com.

5. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law or regulation, including fair lending and advertising laws
• Transmit spam, unsolicited messages, or misleading content
• Collect personal information without proper consent or disclosures
• Attempt to gain unauthorized access to the Service or other users' accounts
• Reverse-engineer, decompile, or copy any part of the Service
• Use the Service in a way that could damage, disable, or impair its operation
• Resell or sublicense the Service without written permission from rebel iQ

You are solely responsible for the content you create, publish, or distribute using the Service, including compliance with RESPA, TILA, state licensing requirements, and any applicable mortgage advertising regulations.

6. Intellectual Property

The Service, including all software, design, text, graphics, and trademarks, is owned by rebel iQ, Inc. and protected by intellectual property laws. These Terms do not grant you any rights to our intellectual property except the limited license to use the Service as described herein.

Content you create using the Service ("User Content") remains yours. By using the Service, you grant rebel iQ a limited, non-exclusive license to host, display, and process your User Content as necessary to provide the Service. We do not sell your content to third parties.

7. Lead Data and Privacy

Leads captured through your rebel iQ AI pages and forms are your data. We store this data on your behalf to provide the Service. Lead data is never deleted as a result of plan changes or downgrades — it remains in your account indefinitely. See our Privacy Policy for details on how we collect and handle data.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, REBEL IQ, INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Termination

You may cancel your account at any time from your account settings. We may suspend or terminate your account at our discretion if you violate these Terms. Upon termination, your right to use the Service ceases immediately. We may retain your data for a reasonable period as required by law or legitimate business purposes.

11. Governing Law and Disputes

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved through binding arbitration in San Diego, California, except that either party may seek injunctive relief in a court of competent jurisdiction.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting a notice in the platform or by email. Continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.
